Terms of Service
These Terms are the agreement between KITSIS CRM and the company that uses the service. They are also the “regulamin” required by the Polish Act on Providing Services by Electronic Means of 18 July 2002.
1. Who we are
KITSIS CRM (“KITSIS”, “we”, “us”) is a sole proprietorship registered in the Polish register of business activity (CEIDG) under tax number NIP 5223380752. Its full business name and registered address are public in CEIDG under this number.

2. Words used in these Terms
- Service: the KITSIS CRM web application at app.kitsiscrm.com, its API at api.kitsiscrm.com and the related emails and notifications.
- Customer or you: the company or other business that creates a workspace and accepts these Terms.
- Workspace: your company’s space in the Service.
- Owner: a person with the owner role in the workspace. Owners act for the Customer.
- Users: people the Customer invites to the workspace.
- Customer Data: everything the Customer and its Users put into the Service or connect to it: contacts, deals, messages, files, call records and so on.
3. Business use only
The Service is for businesses. By accepting these Terms you confirm that you use the Service for your business, trade or profession, and that the person who accepts them may act for the Customer.
4. How the agreement starts
- The agreement starts when you create a workspace. To create one, you enter the company name, an email address and a password, and confirm the email address with a code we send to it. By creating the workspace you accept these Terms and the Data Processing Agreement.
- The Customer is responsible for what its Users do in the workspace and for keeping their passwords and devices safe.
- Tell us at once at security@kitsiscrm.com if you suspect someone else has access to your account.
5. What the Service does
The Service is a customer relationship management system: deals and pipelines, contacts and companies, tasks and calendar, team chat, email connected to your mailboxes, files and a shared drive, reports, web forms, online booking and integrations. The current list of features is on kitsiscrm.com and in the Service. We may change, add or remove features. We will not remove a feature that is central to the Service without telling Owners by email at least 30 days in advance.
6. Technical requirements
You need an internet connection and one of the two latest versions of Chrome, Safari, Firefox or Edge, with JavaScript and cookies allowed for kitsiscrm.com. On iPhone, notifications work when the app is added to the Home Screen. Connected mailboxes, telephony and other integrations need an account with the provider you connect.
7. Prohibited use
You and your Users must not:
- put unlawful content into the Service or use it for unlawful purposes;
- send spam or messages to people who have not agreed to receive them where their consent is required by law;
- upload malware or try to get into other workspaces, our servers or data that is not yours;
- overload the Service on purpose, get around its limits or test its security without following our security policy;
- resell the Service without our written consent.
We may block access to content or a workspace that breaks these rules. We will tell the Owners why, unless the law or a security risk does not allow it.
8. Prices and payment
- The price is per person per month: 15 EUR for each User, or 12 EUR for each User when the workspace has 10 Users or more. Paid a year ahead, the prices are 12 EUR and 10 EUR. A User counts from the day they accept the invitation until the day they are deactivated. Changes during the period are counted by days and settled on the next invoice.
- Prices are final. No VAT is charged on them.
- A new workspace has 14 days of free trial. No payment card is needed to start. To keep working after the trial, add a card in the Service; the first charge is on the day the trial ends. If no card is added, the workspace becomes read-only when the trial ends (point 5).
- Payments are processed by Stripe. Invoices, card changes and cancellation are in the billing portal reached from the Service.
- If a payment fails, Stripe retries it. If the subscription stays unpaid or ends, the workspace becomes read-only: you can look at your data and download it, but cannot change it. Section 10 explains what happens next.
- We may change prices with at least 30 days’ notice by email. The new price applies from your next billing period after the notice period.
- Credits that arise when Users are removed are used against future invoices. They are not paid out.
9. Term and cancellation
- A monthly subscription renews every month, a yearly subscription every year.
- You can cancel at any time in the billing portal. Cancellation takes effect at the end of the paid period.
- We may end the agreement with 30 days’ notice by email. If we do, we refund the prepaid fees for the time after the end.
- Either side may end the agreement at once by written notice if the other side seriously breaks it and does not fix the breach within 14 days after being asked to.
10. Your data when the agreement ends
- You can download all Customer Data at any time: in the Service, Settings → Data → “Download all data”. The archive contains all records as JSON and CSV files and all stored files.
- When the subscription is unpaid or has ended, the workspace stays read-only for 30 days. We email the Owners 14 days and 1 day before the deletion date. After 30 days the workspace and all Customer Data are deleted.
- An Owner can delete the workspace in Settings → Data. Deletion happens 7 days later, and until then the Owner can cancel it.
- Deletion is final. Backup copies that still hold the data expire on their own no later than 35 days after deletion. We cannot restore one workspace from them.
11. Customer Data and personal data
- Customer Data belongs to the Customer. We use it only to provide the Service, as described in the Data Processing Agreement, which is part of these Terms.
- The Customer is responsible for having a legal basis for the personal data it puts into the Service and for informing the people concerned.
- How we handle the data of Users and other people for our own purposes is described in the Privacy Policy.
12. Availability and support
- We work to keep the Service available at all times. Updates are installed without stopping the Service where possible. Planned work that needs a stop is announced in advance by email or in the Service.
- We do not promise a specific availability level, unless agreed in a separate written agreement.
- Support is by email at support@kitsiscrm.com.
13. Liability
- Incidents we fix. If the Service is unavailable, or Customer Data is damaged or lost, and we restore the Service and the data (from our systems or from backups), you are not charged for the days on which the Service was unavailable. This is the full compensation for such an incident. We owe no damages for the interruption itself.
- Data that cannot be restored. If Customer Data is lost or damaged through our fault and cannot be restored, we are liable for the actual damage it causes, within the limits below.
- Limit. Our total liability under these Terms and the Data Processing Agreement is limited to the fees the Customer paid us for the Service in the 6 months before the event that caused the damage.
- Excluded damage. We are not liable for lost profits, lost revenue, lost business or other indirect damage.
- Where the limits do not apply. These limits do not apply to damage caused intentionally (Article 473 § 2 of the Polish Civil Code) or to liability that cannot be limited by law.
- We are not liable for services we do not run: mailboxes, telephony, advertising platforms and other services the Customer connects, and the internet connection between them and us.
14. Complaints
Send complaints to support@kitsiscrm.com. Describe what happened, when, and which workspace it concerns. We reply within 14 days. If we need more time, we tell you why and when you will get an answer.
15. Changes to these Terms
We may change these Terms. We email the Owners about changes that affect your rights or obligations at least 30 days before they take effect. If you do not agree, you can cancel before the change takes effect. Smaller changes, such as corrections or new contact details, take effect when published. The date of the current version is at the top of this page.
16. Law and courts
These Terms are governed by Polish law. Disputes are decided by the Polish common court that has jurisdiction over the registered place of business of KITSIS CRM. This does not take away rights that mandatory law gives you.
17. Language
These Terms are written in English. Translations are for convenience. If a translation differs, the English version applies.
